Recordkeeping position for wholly synthetic adult depictions

This statement concerns the fictional AI character depictions supplied through Sugar AI, operated by Averlo, LLC at https://sugarai.fun/ and https://sugarai.art/.
1. Scope of the Synthetic Character Service
Sugar AI permits fictional adult characters, including realistic-looking virtual adults. The current product rules prohibit real-person image uploads, characters based on identifiable real people and real-person face swaps, even if permission is claimed. Identity information collected separately for user or contributor verification is not character content and must not enter the generation or publication process.
2. Recordkeeping Position for Wholly Synthetic Depictions
For a depiction that is wholly computer-generated, has no actual human performer and does not incorporate a depiction of an actual person, there is no real performer whose identity and age records can be collected for that depiction. Averlo's position is that the performer recordkeeping requirements of 18 U.S.C. Sections 2257 and 2257A do not apply to those wholly synthetic depictions. This position is confined to the stated production facts and does not claim a blanket exemption for all material merely described as "AI".
This statement covers fictional characters and media created for Sugar AI that are wholly computer-generated and do not incorporate a depiction of an actual person. Real-person uploads and identifiable real-person characters are prohibited.
3. Limits and Product Changes
Digitally altering an actual person's image is different from creating a wholly fictional person. A license, an adult age label or an AI transformation does not automatically remove applicable recordkeeping duties. We do not rely on this statement for real-performer or mixed-source content. Such material is prohibited under the current product rules and is restricted if discovered.
Real-performer material is not part of the service. This statement is not a records-custodian disclosure for such material.
4. Safety and Contact
Every permitted character must clearly be an adult. Child sexualization, non-consensual imagery and other prohibited content remain prohibited regardless of recordkeeping classification. Report actual-person resemblance or a content concern through the Content Removal Policy.
