Copyright notice, counter-notice, and repeat-infringer procedures
The English version of these policies controls. Any translation is provided only for convenience.
Averlo, LLC respects copyright in connection with Sugar AI at https://sugarai.fun/ and https://sugarai.art/. This Policy explains copyright notices, counter-notices and repeat-infringer handling under 17 U.S.C. Section 512 where applicable. It does not claim that all AI-generated or operator-created material is protected by a safe harbor.
1. Copyright Contact
Send notices and counter-notices to:
- Averlo, LLC, operating Sugar AI
- 1021 E Lincolnway Suite #10730, Cheyenne, Wyoming 82001, United States
- Email: [email protected]
This contact covers https://sugarai.fun/ and https://sugarai.art/.
2. Copyright Notice
A rights holder or authorized agent should provide:
- A physical or electronic signature.
- Identification of the copyrighted work, or a representative list for multiple works at one site.
- Identification of the allegedly infringing material and information reasonably sufficient to locate it, including a URL or content identifier where available.
- Contact details sufficient to reach the sender, including an address, telephone number and email if available.
- A statement of good-faith belief that the complained-of use is not authorized by the copyright owner, its agent or the law.
- A statement that the notice is accurate and, under penalty of perjury, that the sender is authorized to act for the owner of the exclusive right allegedly infringed.
Consider lawful authorization and applicable exceptions, including fair use, before sending a notice. We do not require a copyright registration number as a condition of receiving a notice.
3. Response
We act expeditiously to remove or disable access to material identified in a substantially compliant notice and take reasonable steps to inform the contributing user where applicable. If the notice omits information needed under the statute, we take reasonable steps to contact the sender and assist completion where required. A related urgent safety report is handled without waiting for the copyright process.
4. Counter-Notice
If material you provided was removed through the copyright process because of a mistake or misidentification, send a counter-notice containing:
- Your physical or electronic signature.
- Identification of the removed material and its location before removal.
- A statement under penalty of perjury of your good-faith belief that removal or disabling resulted from mistake or misidentification.
- Your name, address and telephone number; consent to the jurisdiction of the Federal District Court for the district in which your address is located, or, if outside the United States, any judicial district in which Averlo may be found; and a statement that you will accept service of process from the original notice sender or their agent.
We promptly forward a qualifying counter-notice to the original complainant. Where the statutory process applies, restoration occurs no sooner than 10 and no later than 14 business days after receipt of the counter-notice unless we first receive notice that the complainant has filed a court action seeking to restrain the relevant infringement. An independent prohibition under our safety or community rules can remain a basis for keeping material unavailable. We explain that separate basis where lawful.
5. Repeat Infringement, Privacy and Other Reports
We adopt and reasonably implement termination of repeat infringers in appropriate circumstances, consider relevant notices and counter-notices, and accommodate applicable standard technical measures. Knowingly material misrepresentations in a notice or counter-notice may have consequences under Section 512(f).
Notices and counter-notices may need to be shared with the other party, advisers or competent authorities. Do not include unrelated intimate information or unnecessary identity records. Use a representative where appropriate. A person depicted without consent need not own copyright and should use the Content Removal Policy's urgent route at [email protected]. A copyright counter-notice never overrides a separate child-safety or intimate-image removal duty.
