Terms governing access to and use of Sugar AI

IMPORTANT: SUGAR AI IS AN ADULT-ONLY SERVICE. YOU MUST BE AT LEAST 18 YEARS OLD AND AT LEAST THE AGE OF MAJORITY WHERE YOU LIVE. THE SERVICE MAY DISPLAY OR GENERATE EXPLICIT, EROTIC, OR OTHER ADULT-ORIENTED AI CONTENT.
The English version is the principal version. Translations assist users; mandatory local-language and consumer-protection requirements prevail where applicable.
These Terms & Conditions (the "Terms") are an agreement between you and Averlo, LLC, a Wyoming limited liability company ("Averlo", "we", "us" or "our"), operating Sugar AI at https://sugarai.fun/ and https://sugarai.art/ (the "Service"). Both domains are covered by the same policies. A purchase on one domain is for that account. It is not a second charge on the other domain.
By accepting these Terms when registering or purchasing, or otherwise using the Service where an enforceable agreement is formed, you agree to these Terms and the applicable Refund and Cancellation Policy, Safety Guidelines, Blocked Content Policy, Underage and Age Assurance Policy, Community Guidelines, Content Provider Agreement, Content Removal Policy, Complaints Policy, and Anti-Trafficking and Anti-Exploitation Policy. The Privacy Policy and Cookies Policy explain data handling; acknowledging them is not consent to optional tracking, model training or special-category processing. The policies are available in Legal Information on each domain. If you do not accept the applicable rules, do not use the affected service.
1. The Service
Sugar AI is an entertainment platform that may offer AI companions, interactive chats, character creation, and AI-generated text, images, audio, video, or other media. Features vary by account, device, location, and product version. We may add, modify, suspend, or discontinue any feature.
AI companions and outputs are synthetic simulations. They are not human beings, do not possess consciousness or feelings, and may produce inaccurate, inconsistent, unexpected, or offensive responses. Do not rely on the Service for factual accuracy or important decisions.
The Service is not healthcare, therapy, crisis support, legal advice, financial advice, or another professional service. It is not designed for emergencies. If you or another person may be in immediate danger, contact local emergency services or an appropriate qualified professional.
Sugar AI permits fictional adult characters, including photorealistic virtual adults. A realistic visual style does not mean a character is a real person. Uploading a real person's picture, creating a character based on an identifiable real person, and real-person face swaps, sexual deepfakes or voice impersonation are prohibited, even if a user claims consent. Public figures and the user's own real likeness are included in this restriction. Do not upload identity documents into chats, generation, or community content.
Users may submit eligible generated content to the built-in community. Publication is subject to the Community Guidelines and Content Provider Agreement. A private chat or creation does not automatically become a public post. Service features do not authorize material involving minors, trafficking, non-consensual conduct or any category prohibited by our policies.
2. Eligibility, Age Assurance, and Registration
Adults only. You must be 18 or older and at least the age of majority in your jurisdiction. If the higher local age is 19 or 21, that higher age applies.
Legal capacity. You must be able to form a binding contract and must not be barred from the Service under applicable law.
Age confirmation. Before adult content is shown, you must confirm that you are at least 18 and at least the age of majority where you live. We store that confirmation in a first-party cookie. It is not a government identity check. A cryptocurrency payment or account registration does not prove age. Do not use the other Sugar AI domain to evade a restriction. Where the law requires an age check we do not offer, we may restrict access. Community publication is limited to eligible adult accounts and must follow the Content Provider Agreement.
Accurate information. Registration information must be truthful, complete, and current. Registration is void where prohibited.
One personal account. Unless we approve otherwise, you may maintain only one account and may not sell, transfer, lend, or share it.
Account security. You are responsible for safeguarding credentials and for activity through your account. Notify us promptly of suspected unauthorized access.
We may suspend an account that appears to belong to a minor. A confirmed underage account will be terminated. We may retain limited records needed to prevent re-registration and satisfy legal or safety obligations.
3. Credits and Payment
Sugar AI sells credits as one-time purchases. Checkout shows the credit pack and the price in US dollars. Payment is made in cryptocurrency through NOWPayments at https://nowpayments.io/. You choose the coin on the NOWPayments payment page. There is no subscription, trial, automatic renewal, or automatic top-up.
We do not accept credit cards, debit cards, bank transfers, or other payment methods. Averlo does not receive your wallet private key or full payment credentials. NOWPayments processes the cryptocurrency payment under its own terms. Sugar AI remains responsible for the service and for these content policies.
Credits give limited personal access to specified digital features. They are non-transferable, cannot be cashed out, and are not a payment instrument. Credits do not expire unless the purchase screen says they do. Spending credits to unlock a character is a one-time use of credits you already hold. It is not a separate charge and it does not renew. Bonus credits, if offered, have no cash refund value. A purchase does not entitle you to prohibited content and does not guarantee that a community post will be approved. Failed delivery, duplicate charges, and mandatory consumer remedies are handled under the Refund and Cancellation Policy.
Prices or paid benefits may change for future purchases. We do not change the price of a purchase you have already paid for. If we discontinue a paid feature without your breach, refunds of undelivered value are handled under the Refund and Cancellation Policy. Billing questions go to [email protected].
4. Account Termination and Suspension
You may request deletion by emailing [email protected]. Deletion removes access to account content after the confirmation process, subject to the Privacy Policy's retention duties and your statutory rights. Credit purchases do not renew, so there is no recurring charge to cancel. Deletion does not eliminate a refund or other remedy that you are legally entitled to receive.
We may restrict, suspend, or terminate access immediately when we reasonably believe you violated these Terms or another policy; created a safety, security, legal, payment, or reputational risk; attempted to evade enforcement; or used the Service in a way likely to harm Averlo, another person, or the public. Serious safety violations may result in permanent termination without refund to the extent permitted by law.
5. User Content and Acceptable Use
"User Content" means prompts, messages, character descriptions, names, profile information, images, audio, video, files, feedback, and other material you submit or transmit. You are responsible for User Content and for ensuring that you have all rights and consents necessary to provide it.
5.1 Adult Content That May Be Permitted
Subject to these Terms and the Safety Guidelines, the Service may permit fictional, consensual adult themes involving characters who are clearly represented as 18 or older. The availability of an adult-content feature does not permit any prohibited content or conduct.
5.2 Strictly Prohibited Sexual and Exploitative Content
Minors and age ambiguity. Any sexual, nude, fetish, romanticized, or suggestive content involving or appearing to involve a person under 18, whether real, fictional, illustrated, animated, AI-generated, edited, or morphed. This includes age-regression, youthful or prepubescent traits, school-child framing, explicit underage ages, or attempts to make an adult character appear to be a minor.
Child exploitation. Child sexual abuse material, grooming, sexual solicitation of minors, instructions for exploitation, links to such material, or attempts to evade age-related filters through code words, euphemisms, translations, incremental prompting, or jailbreaks.
Trafficking and commercial sexual exploitation. Recruiting, advertising, arranging, soliciting, purchasing, selling, or facilitating prostitution, escorting, trafficking, forced labor, sexual servitude, or any "sugar" arrangement involving payment or anything of value for sexual contact. The Sugar AI name does not describe or permit real-world compensated dating or sexual services.
Real-person likenesses and intimate imagery. Uploading any real-person image or creating any identifiable real-person character is prohibited. This includes the user's own likeness, public figures, former partners, sexual deepfakes, face swaps and requests to transform a clothed real person into intimate content. Claimed consent does not create an exception. Accidental resemblance can be reported under the Content Removal Policy.
Sexual violence and coercion. Rape, sexual assault, blackmail, incapacitation, trafficking, forced sexual conduct, or other sexual activity without freely given consent.
Other prohibited sexual material. Bestiality or zoophilia, necrophilia, incest, sexualized death or severe injury, or sexual content otherwise prohibited by applicable law.
5.3 Other Prohibited Content and Conduct
Content that is illegal, fraudulent, threatening, harassing, defamatory, or invasive of privacy; doxxing or disclosure of personal, confidential, or authentication information.
Hateful or discriminatory content that attacks, dehumanizes, or incites violence against a protected class; praise, recruitment, or operational support for extremist or terrorist organizations.
Promotion or encouragement of suicide or self-harm; unqualified diagnosis or instructions presented as medical, mental-health, legal, or financial advice.
Extremely graphic real-world violence, torture, mutilation, cannibalism, or cruelty; instructions to obtain or use illegal weapons or to commit, conceal, or evade detection of criminal activity.
Material that infringes copyright, trademark, publicity, privacy, contractual, fiduciary, or other rights; impersonation or false affiliation.
Malware, malicious code, security testing without authorization, interference with the Service, scraping, automated extraction, reverse engineering, model extraction, or attempts to bypass access controls, filters, rate limits, or moderation systems.
Spam, unauthorized advertising, pyramid schemes, commercial solicitation, contact harvesting, or directing users off-platform for prohibited transactions.
Use of the Service to develop or improve a competing model or service, create biometric identification systems, or make eligibility decisions in high-impact domains without our written authorization.
Any conduct that violates applicable law, materially interferes with another person's use, or exposes Averlo, its partners, users, or the public to unreasonable harm or liability.
Averlo may investigate suspected violations, block prompts or outputs, limit sharing, remove content, preserve relevant records, suspend or terminate accounts, prevent re-registration, notify payment or hosting partners, and refer matters to competent authorities. We may use automated and human review. No moderation system is perfect, and the absence of a warning does not make content permissible.
6. Anti-Trafficking, CSAM, and Non-Consensual Content
Averlo has zero tolerance for human trafficking, sex trafficking, forced labor, child sexual exploitation, sexual abuse material involving minors, and non-consensual intimate imagery. This prohibition applies to users, employees, contractors, moderators, vendors, affiliates, creators, and marketing partners.
Credible reports of child exploitation, trafficking or non-consensual intimate imagery receive urgent review and provisional restriction. Once illegal content is identified, access is removed immediately. The Content Removal Policy sets the specific deadlines for removal, including the 48-hour procedure for valid non-consensual intimate image requests.
Confirmed prohibited material will be removed. The responsible account may be terminated and proportionate repeat-abuse controls applied.
We may preserve content, logs, IP information, payment records, and communications when required for safety, legal compliance, litigation hold, or law-enforcement requests.
We will report apparent child exploitation or trafficking to NCMEC, law enforcement, or other competent authorities when required or appropriate under applicable law.
We do not retaliate against any person who makes a good-faith safety report.
7. Community Publication and Personal Use
You must actively choose to submit a generated character or item to the community. Only content accepted through the publication review may appear there. Submitting, paying for or generating an item does not mean that it has been approved for publication. A changed image, caption, thumbnail, tag, link or character description must be reviewed again before the changed version is published.
Public posts and your selected public profile fields can be viewed by other eligible users and may be copied outside our control. Do not include private chats, identifying details or another person's information in a public post. You may request removal of your post; our ability to remove off-platform copies is limited. Reports and legal preservation duties continue to apply after removal.
Your license is for personal, non-commercial entertainment use, including permitted sharing inside Sugar AI. It does not authorize resale, commercial distribution, real-world sexual services or presenting AI content as authentic evidence of a person or event. We can restrict, remove or change visibility of content to enforce these policies. Decisions can be reviewed through the Complaints Policy.
8. Intellectual Property
8.1 Averlo Materials and AI Outputs
Averlo and its licensors own the Service, software, models, designs, trademarks, databases, characters supplied by us, and other proprietary materials. To the extent permitted by law, Averlo also retains rights in service-generated characters and outputs. Your payment grants only a limited, personal, revocable, non-exclusive, non-transferable license to access and use the relevant Service feature under these Terms. It does not transfer ownership of the Service, a model, a character, or an output.
The legal status and protectability of AI-generated material vary by jurisdiction. We do not promise that an output is unique, non-infringing, or eligible for copyright, trademark, publicity-right, or other protection. Other users may receive similar outputs.
8.2 License to User Content
You retain any rights you lawfully hold in material you submit. You grant Averlo and the service providers acting for it a worldwide, non-exclusive, royalty-free license to store, process, transmit, format, moderate and display that material to provide the feature you request, maintain security and comply with law. If you expressly submit content to the community, this includes making the approved content available to community users within the scope of your publication settings. This license is limited to those purposes and the applicable retention period. It does not itself authorize unrelated advertising use of private chats, AI model training on personal information, or use of a real person's likeness.
8.3 Feedback
If you provide ideas or feedback, you grant Averlo a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you without permission.
9. Copyright Reports and Content Removal
The DMCA Copyright Policy provides the notice, counter-notice, and repeat-infringer procedures, and the copyright contact. Sugar AI will respond expeditiously to a substantially compliant copyright notice and apply the statutory counter-notice process where applicable. A policy page alone does not establish that a service or a particular activity qualifies for a copyright safe harbor.
Anyone can make a safety or likeness report without holding copyright or having a Sugar AI account. Use the Content Removal Policy for non-consensual intimate imagery, accidental resemblance, personal information and other rights concerns. A copyright counter-notice does not authorize restoring material that independently violates safety, age or real-person restrictions.
10. Third-Party Services and Links
The Service uses NOWPayments for cryptocurrency checkout, and may depend on cloud hosts, AI providers, authentication services, or external links. Third parties operate under their own terms and privacy practices. We are not responsible for third-party services, content, availability, or conduct, except to the extent applicable law provides otherwise.
11. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Averlo, its affiliates, licensors, officers, directors, employees, contractors, and agents from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your User Content, your use or misuse of the Service, your violation of these Terms or law, or your infringement of another person's rights. Averlo may control the defense of a covered matter, and you agree to cooperate.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." AVERLO DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING.
We do not warrant uninterrupted or secure operation, correction of defects, absence of harmful components, accuracy or uniqueness of AI outputs, compatibility with every device, or that the Service will meet your expectations. You may encounter adult, offensive, or otherwise objectionable material. You are responsible for protecting personal information you disclose and for evaluating outputs before relying on or sharing them.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVERLO AND ITS AFFILIATES, LICENSORS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE; SUBSTITUTE-SERVICE COSTS; OR SERVICE INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, CONTENT, THIRD-PARTY CONDUCT, OR UNAUTHORIZED ACCESS, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVERLO'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AVERLO FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $100. These limitations do not exclude liability that cannot lawfully be limited.
14. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES INDIVIDUAL BINDING ARBITRATION FOR MOST DISPUTES AND INCLUDES A CLASS-ACTION AND JURY-TRIAL WAIVER, TO THE EXTENT PERMITTED BY LAW.
Before starting arbitration or litigation, a party must send a written notice describing the dispute and requested relief. The parties will attempt in good faith to resolve the dispute informally for 60 days after receipt. The notice to Averlo must be sent to the contact email below.
For users in the United States, an unresolved dispute arising from the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable consumer rules and the Federal Arbitration Act. The arbitration may be conducted by video, telephone, documents, or an in-person hearing in a location reasonably convenient to the consumer, as the applicable rules permit. Either party may bring an eligible individual claim in small-claims court or seek urgent equitable relief to protect intellectual property, privacy, or data security.
For users outside the United States, disputes may be brought before the courts and consumer dispute bodies available under applicable law. These Terms do not require an overseas consumer to arbitrate in London. Mandatory consumer remedies, local forums and regulator complaints remain available.
For U.S. claims that may lawfully be subject to individual arbitration, claims must be brought individually rather than as a class or representative proceeding. No waiver removes a non-waivable consumer remedy, statutory public relief or right to approach a regulator. Any court-trial waiver applies only to the extent enforceable. Informal dispute steps do not delay urgent safety reports, statutory removal duties, a refund request, or a mandatory filing deadline.
15. Governing Law
These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-laws rules, except that mandatory consumer protections in your jurisdiction continue to apply. Any claim that is not subject to arbitration and is not eligible for small-claims court must be brought exclusively in a state or federal court located in Wyoming, and each party consents to the personal jurisdiction and venue of those courts, except where applicable law requires another forum.
16. Changes to These Terms
We may update these Terms. We will post the revised version and update the date above. If a change is material, we will provide additional notice when required by law. Continued use after the effective date means you accept the revised Terms. If you do not accept them, stop using the Service.
17. General Terms
Entire agreement. These Terms and incorporated policies are the entire agreement about the Service and replace prior understandings on the same subject.
Severability. If a provision is unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions stay effective.
No waiver. Failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, financing, reorganization, sale, or transfer of the Service.
Force majeure. We are not responsible for delay or failure caused by events reasonably beyond our control.
Headings. Headings are for convenience and do not limit the provisions.
